Terms and Conditions FAQ’S

  • Membership Terms and Conditions:

    Farm Girl Fitness and its owners, directors, officers, employees, contractors, agents, heirs and assigns, as applicable (collectively, Released Parties”). 

    In consideration of participating in the fitness training services provided by Farm Girl Fitness which includes small group training classes, bootcamps, stretch classes, circuit classes, fundraisers, outdoor and indoor workouts, personal training sessions, corporate wellness/team building events, or physio fitness sessions, (the “Services”) and in using the premises, facilities and/or equipment, if applicable, I, the undersigned, acknowledge and agree as follows:

    Acknowledgment of Risk

    I acknowledge that there are inherent risks and dangers in participating in the Services, including, but not limited to (i) minor injuries such as scratches, bruises, muscle aches, soreness and sprains; (ii) major injuries such as joint or back injuries, bone breaks, eye injuries or loss of sight, heart attacks and concussions; and (iii) catastrophic injuries including paralysis or even death. I understand that the description of the risks in this Release and Waiver is not complete.

    Voluntary Assumption of Risk

    I voluntarily choose to participate and assume all risks and dangers of my participation in the Services, including all risks of injury, physical or financial loss and even death that may result from participating in the Services, even if the risks are created by the carelessness, negligence or gross negligence of any of the Released Parties or any other third-party. I further understand that I am aware of my own capabilities and limitations and am solely responsible for my own actions and inactions and have the autonomy to decide whether I should or should not, continue to participate in the Services. 

    Representation and Warranty

    I represent and warrant that I am aware of the physical demands of the Services and that to the best of my knowledge, I am physically and medically able to participate in the Services. I acknowledge and agree that my Farm Girl Fitness Trainer/Instructor/Coach reserves the right to refuse my participation in any or all of the Services, if my Trainer/Instructor/Coach believes my participation would put themselves, any Released Parties or any other participants at risk, in their sole discretion. 

    Release, Waiver, and Indemnity

    I hereby release, indemnify and save harmless the Released Parties from any and all responsibility, liability, claims, actions, suits, costs, loss, expenses and damages arising directly or indirectly from my participation in the Services to the fullest extent permitted, including financial damages or personal injuries, however caused, including negligence. I further indemnify the Released Parties from any costs, damages or expenses, including legal fees, they may incur as a result of defending any claim made by me or on my behalf. This Release and Waiver shall be effective and binding upon my heirs, next of kin, executors, administrators, successors, assigns and representatives as applicable. This clause survives indefinitely.
    I voluntarily agree to assume all risks and accept sole responsibility for myself and hereby release Farm Girl Fitness, any of its employees, coaches or instructors, and any of the property owners, from any liability, claims, actions, damages, costs or expenses that may arise from any accidents that I am involved in.

    Limitation of Liability

    If for any reason the Released Parties are found liable for damages arising directly or indirectly from this Release and Waiver, liability will be limited to the greatest extent possible in the governing jurisdiction and in no case exceed the amount of any fee I have paid to Trainer. 

    Severability

    If any of the provisions of this Release and Waiver are found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not, to the extent permitted by law, in any way be affected and will remain enforceable.

    Governing Law and Jurisdiction

    This Release and Waiver is governed by and interpreted in accordance with the laws of Ontario and the federal laws of Canada where applicable. Any disputes arising directly or indirectly from this Release and Waiver will be submitted and heard exclusively in the courts of Milton, Ontario.

    Counterparts and Electronic Signing

    This Release and Waiver may be signed electronically and/or in counterparts that, when taken together, constitutes a fully signed and legally binding agreement.

    1. I personally commit to informing my coach immediately of anything that makes me feel uncomfortable, if I start to feel dizzy, nauseous, or am experiencing pain. I realize that keeping the coach informed of how I'm feeling is essential to them being able to help.

    2. Farm Girl Fitness, its Coaches and instructors, have the right to call for emergency medical care and transportation in order to obtain medical care in the event of an injury to myself, as the Coach may see fit. This release extends to any liability that may arise from or is in any way connected to the medical treatment or transportation provided in the case of an emergency. 

  • PHOTOGRAPHY RELEASE:

    When you sign our online waive you give permission for photo or video of you to be taken while participating in any event, class, or workshop at Farm Girl Fitness. You acknowledge and give permission that these photos and videos can be used in any Farm Girl Fitness promotional material without compensation. If you do not consent to this you agree to tell the owner, coach or photographer beforehand so that they can gladly honor your wishes.

  • NO-SHOW POLICY:

    • No-shows to class are detrimental to the studio, the coaches, and fellow members trying to get a spot in class. Because every participant is reminded of their class booking 24 hours in advance, and because cancelling a class takes on average 10 seconds to complete, no-shows are unacceptable and have consequences.

    • No-shows to class will first be contacted by Farm Girl Fitness management to ensure their well-being.

    • A first no-show will result in a warning. After one warning, a $25 charge will be applied for subsequent no-shows.

    • If the no-show is due to an emergency or poor road/weather conditions, (see below for definitions of "emergency" or "poor road/weather conditions"). the fee may be waived at management's discretion.

    • Waiving the fee based on these exceptions are granted on the honor system and should not be abused. If management believes this is being misused, the charge may be enforced at their discretion.

    Starting December 31, 2024, the following CANCELLATION POLICIES will be in full effect:

    • Any class cancellation 10 hours or less of the scheduled class start time will be subject to a $10 charge. 

    • Sickness, road/weather conditions or personal emergencies may be exceptions to the late charge. (See below for definitions of these exceptions).

    • If you are canceling at the last minute because of sickness, road/weather conditions or a personal emergency it is your responsibility to let us know before the end of the day of the booking via email, info@farmgirlfitness.ca, (do not phone and do not text), so that we can either void the charge (if caught in time) or credit your account.

    • PLEASE NOTE: Refunds will not be given for these charges even if it is deemed that there is an exception to the charge. Instead Farm Girl Fitness will give a credit to your account to be used on your next purchase or transaction. When someone late cancels the system the charge is automatic and instantaneous so there is no time to review the cancellation or wait for an email to come in explaining why the cancellation happened before the charge goes through.

    • All of these exceptions are based on the members' understanding and respect of THE HONOR SYSTEM. If Farm Girl Fitness management feels that this provision is not being respected and/or is being abused, management reserves the right to deny the exception.

    Definition of “Sickness”:
    - Anything that shows signs of sickness (sneezing, coughing, fever, chills, body aches, nausea, vomiting, diarrhea, etc) and/or anything that comes on suddenly, preventing you from canceling early. 

    This means things like pre-existing injuries or simply “feeling tired” are not covered under this policy. If you injure yourself right before class, that is different and might be considered an emergency exception. If you have a pre-existing injury that suddenly acts up before class, this would not be covered.

    People with pre-existing injuries or conditions that tend to have flare ups may want to hold off on booking early and instead may want to switch to booking at the last minute based on how they’re feeling. 

    Definition of “Bad Road/Weather Conditions”:
    - Ultimately only you can decide if you feel comfortable driving when the weather creates bad road conditions. If you feel that you cannot arrive safely or don’t feel comfortable driving because of the road or weather conditions where you are, please cancel your booking as early as possible. 

    Definition of “Emergency”:
    - Simply put, an emergency is something that involves life or death, or emergency services (ambulance, fire, or police), being called. 

    This means things like having to work late because of a “work emergency”, bad traffic, family matters, plans changing, etc, do not qualify as an emergency. We understand that things come up and that life happens, however this does not fall under the heading of an emergency.

  • When you sign our waiver you agree to the following:

    I hereby acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to the virus while in the presence of others at Farm Girl Fitness, 10708 Third Line, Milton, Ontario. 

    I acknowledge that such exposure or infection may result in personal injury, permanent disability, illness or death. 

    IF I AM SHOWING ANY OF THE FOLLOWING SYMPTOMS OF COVID-19, EVEN IF I MAY SUSPECT IT IS NOT COVID-19, I AGREE TO STAY HOME:

    Fever, Chills, Cough, Nausea, Body Aches, Congestion, Diarrhea, Loss of taste or smell, or Sore throat. 

    I agree to stay home and away from Farm Girl Fitness Studio and its outdoor classes if I have:

    - If I am awaiting the results of a COVID-19 test.

    - If someone in my household is awaiting the results of a COVID-19 test. 

    I acknowledge that my actions in this regard can have a profound bearing both physically and financially on the owners and employees of Farm Girl Fitness and the members who attend their classes. If I disregard these clear regulations I am aware that I can be held responsible for my careless actions. 

  • Farm Girl Fitness CODE OF CONDUCT:

    At Farm Girl Fitness we are committed to fostering a positive and respectful environment for all our members and staff. To ensure a harmonious and enjoyable experience for everyone, we expect all individuals who sign this form to adhere to the following code of conduct:

    1. Respect for All

    • Treat every individual with kindness, courtesy, and respect, regardless of differences in background, ability, or fitness level.

    • Avoid discriminatory or derogatory language, behavior, or actions towards any person within the studio premises.

    2. Punctuality

    • Arrive on time for scheduled classes, appointments, or training sessions. Late arrivals may disrupt the class or session and inconvenience other participants.

    • Late arrivals more than 15 min late may be asked to leave class and will be considered a late cancellation.

    3. Compliance with Studio Rules

    • Familiarize yourself with and adhere to all studio policies and guidelines regarding equipment usage, class schedules, booking policies, and safety protocols.

    • Follow the instructions of our certified instructors and staff members at all times.

    • Refrain from engaging in any behavior that may endanger yourself or others, including reckless or aggressive actions during workouts.

    4. Communication and Feedback

    • Communicate any concerns, suggestions, or feedback to our staff members or management team in a respectful and constructive manner.

    • Encourage open and honest communication among fellow members to foster a supportive community atmosphere.

    5. Confidentiality and Privacy

    • Respect the confidentiality and privacy of other members and staff members, refraining from sharing personal information or discussing others' experiences without consent.

    6. Consequences of Violations

    • Failure to comply with this code of conduct may result in disciplinary action, including but not limited to warnings, suspension of membership privileges, or termination of membership, as determined by the management team.
